Terms & Conditions

  • 1. Repair Service
    • a. In all cases, an assessment and minimum charge of $30.00 + GST may apply.
    • b. Mutual Communication provides its customers with a 1 month repair warranty.
    • c. If you cannot be contacted after 30 days of the service completion or assessment you agree that the device may be kept in lieu of payment.
    • d. Loan devices are available (Conditions Apply) and must be returned upon service completion.
  • 2. Lay By
    • a. A 10% deposit of the purchase price is required.
    • b. Layby sales are required to be over $50.00 minimum purchase.
    • c. Layby payments must be completed in full within 1 month.
    • d. Payment options are as follows: Daily, Weekly, Fortnightly, and Monthly.
    • e. The buyer may cancel this layby within 48 hours with a full deposit refund. The 10% deposit may not be refundable in all circumstances.
    • f. If the layby is not paid in full by the completion date, or you decide to cancel the layby sale before the layby is completed, we may deduct the selling costs from the amount paid to date.
    • g. At any time during the period of payment you may pay the amount owing in full and receive possession of the goods.
    • h. The buyer's failure to comply with section 2c, shell constitutes cancellation of the layby.
    • i. The goods shall remain the sole property of the seller until the buyer has paid the account in full including any fees due to late payment.
    • j. If the order is cancelled or 2 months payments are missed the goods will be returned to stock, in such cases the rights of the buyer and seller are set out in section 9 of the Layby Sales Act 1971.
    • 3. Warranty
      • a. Mutual Communication Limited backs up its mobile phone accessories with a replacement warranty.
      • b. This warranty covers defective materials and workmanship.
      • c. This warranty does not apply to the cost incurred of removal, reinstallation, or to a product that has suffered through normal wear and tear, alteration, improper installation, physical abuse, or misuse.
      • d. Proof of purchase must be presented with products to validate your claim within the Terms and Conditions of this warranty.
    • 4. Data Loss
      • a. It is the customer's responsibility to back up all data, including: Contacts, Schedule/Calendar, TXT and PXT Messages, Images, Music Files, Games, Customized personal settings and so on, prior to presenting the phone for repair. Mutual Communication Limited will not be liable for any data loss during repair.
    • 5. Courier
      • a. Mutual Communication Limited will not be liable for devices lost or damaged in transit by courier.
    • 6. Disclaimer of Warranties and Limitation of Liability
      • a. THIS SITE IS PROVIDED BY MUTUAL COMMUNICATION LIMITED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
      • b. MUTUAL COMMUNICATION LIMITED MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THIS SITE OR THE INFORMATION, CONTENT, MATERIALS, OR PRODUCTS INCLUDED ON THIS SITE. YOU EXPRESSLY AGREE THAT YOUR USE OF THIS SITE IS AT YOUR SOLE RISK.
      • c. TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, MUTUAL COMMUNICATION LIMITED DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
      • d. MUTUAL COMMUNICATION LIMITED DOES NOT WARRANT THAT THIS SITE, ITS SERVERS, OR E-MAIL SENT FROM MUTUAL COMMUNICATION LIMITED ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
      • e. MUTUAL COMMUNICATION LIMITED WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THIS SITE, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES.
      • f. CERTAIN LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.
    • 7. Consumers Guarantees Act 1993
      • a. Nothing in the Sales Terms is intended to have the effect of contracting out of the Consumer Guarantees Act 1993 ("Act") except to the extent permitted by the Act and the Sales Terms are to be modified to the extent necessary to give effect to that intention.
      • b. Where the Act applies to these Sales Terms: If the products are acquired by you for business purposes, you agree that the Act does not apply; and If the products are not acquired by you for business purposes, we reserve the right to replace any Products which fail to comply with any guarantee contained in the Act.
      • c. You acknowledge that we do not provide any Express Guarantees (as defined in the Consumer Guarantees Act 1993) other than those expressly confirmed by us in writing.
